These General Terms and Conditions will govern the relationship between Colex Uniformes, S.L., located at Polígono Industrial Can Tapioles, Calle Narcís Monturiol, 2 Nave 8-9, 08110 Montcada i Reixac (Barcelona), Spain, with tax ID B63883961 (hereinafter referred to as "Colex") and the third parties (hereinafter referred to as "Users") who register as users and/or purchase products through the official online store of Colex at https://www.tiendacolex.es (hereinafter, the "Store").
1. USER OBLIGATIONS
1.1 The User agrees, in general, to use the Store, purchase Products, and use each of the Store's services diligently, in accordance with the law, morals, public order, and the provisions of these General Terms and Conditions. The User must refrain from using the Store in any manner that may prevent, damage, or deteriorate its normal operation and enjoyment by other Users or that could harm or damage Colex’s, its suppliers’, Users’, or any third parties’ goods and rights. These Terms may be modified. It is the User’s responsibility to read them periodically.
2. PRODUCTS AND PRICES
2.1 Colex reserves the right to decide, at any given time, which Products will be offered to Users through the Store. In particular, Colex may add new Products to the Store at any time, and unless stated otherwise, these new Products will be subject to these General Terms and Conditions. Likewise, Colex reserves the right to stop providing or facilitating access to and use of any Products offered on the Store at any time and without prior notice.
2.2 The Products included in the Store will, as accurately as possible, correspond to the Products actually offered, as allowed by web display technology. The characteristics of the Products and their prices are displayed in the Store. Prices indicated in the Store are in Euros and include VAT, unless otherwise stated.
3. PROCEDURE AND PAYMENT METHOD FOR PRODUCTS
3.1 Within a maximum of twenty-four (24) hours, Colex will send an email to the User confirming the purchase. This email will assign a reference code for the purchase and provide details of the Product, its price, and shipping costs.
3.2 The User purchasing a product through the Store must make the payment using the payment methods specifically detailed in the Store.
3.3 Colex will archive the electronic documents in which the sale is formalized and will send a copy to the User once the purchase is completed. The sale will be conducted in the relevant language.
3.4 The order confirmation sent by Colex does not serve as an invoice, only as a proof of purchase. Colex will send the invoice via email when the products are shipped.
4. RIGHT OF WITHDRAWAL
4.1 The User has the right of withdrawal and can contact Colex via email at online@colexuniformes.com to withdraw from the purchase within a maximum of thirty (30) business days from the receipt of the Product. The return should follow the instructions provided by Colex upon notification of the withdrawal. The User must return the Product within seven (7) days from when Colex provides the return instructions. The User will bear the direct return costs, except for defective items.
4.2 The return will involve a refund of the amount for the returned items. The refund will be made through the same payment method used. The time for the refund will be as established by law.
4.3 The right of withdrawal cannot be exercised if the Product is not in perfect condition. Underwear, socks, and masks CANNOT be returned for refunds or exchanges. Shoes and footwear should be tried on over clean carpet or surfaces. Shoes and footwear with wear, stains, or in poor condition will not be accepted for refunds or exchanges. Items with prints, designs, or similar elements may fade after many washes. We recommend handwashing and following the manufacturer's care instructions.
5. CUSTOMER SERVICE
5.1 For any issues, claims, or exercise of rights, the User can send an email to online@colexuniformes.com.
6. HOME DELIVERY SERVICE
6.1 The sales territory for the Store is exclusively within the European Union, excluding possible free zones within it, so delivery services will only be available to this territory. Products purchased through the Store will be shipped to the delivery address provided by the User once payment is confirmed, with a maximum delivery period of thirty (30) days, as established by law.
Orders to the Canary Islands, Ceuta, and Melilla are subject to customs fees and/or taxes. Colex has no control over these charges and is not responsible for them. Before placing an order, we recommend checking with customs offices for detailed information.
6.2 The delivery service is carried out in collaboration with various reputable logistics operators. Orders will not be delivered to P.O. Boxes, hotels, or other non-permanent addresses.
6.3 Shipping costs are not included in the Product prices. The User will be informed of the exact shipping cost at the time of purchase. Each product page includes a link to consult the corresponding rates.
Colex will make every effort to ensure that the order leaves the warehouse complete. However, we cannot guarantee the availability of all items at all times. Additionally, as we cannot update our online stock outside office hours, there may be slight discrepancies between online stock figures and actual warehouse availability. If an order is incomplete, Colex reserves the right, at its discretion, to make two shipments.
7. INTELLECTUAL AND INDUSTRIAL PROPERTY
7.1 The User acknowledges that all elements of the Store and each of the Products, the information and materials contained in them, the brands, the structure, selection, arrangement, and presentation of their content, and the computer programs used in connection with them, are protected by intellectual and industrial property rights belonging to Colex or third parties, and these General Terms and Conditions do not grant the User any rights over these intellectual and industrial property rights other than those specifically stated.
7.2 Unless authorized by Colex or the third-party holders of the respective rights, or unless legally permitted, the User may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, lend, make available, or allow public access to any of the elements mentioned above. The User agrees to use the materials, elements, and information accessed through the Store solely for personal use and not for any direct or indirect commercial exploitation.
7.3 The User must refrain from bypassing or manipulating any technical devices set by Colex or third parties in the Store.
8. DATA PROTECTION
8.1 In accordance with the applicable legal framework on personal data protection and the General Data Protection Regulation (GDPR), we inform you that the data controller for the data you have provided is Colex Uniformes, S.L. The purpose of collecting this data is to manage the requested order, based on the legal framework set out in the Commercial Code and complementary laws. Your data will be kept confidential and will only be used for this purpose. By checking the relevant box, you consent to the processing of your data for the stated purposes. You can exercise your rights of access, rectification, cancellation, opposition, transparency, erasure, limitation, and portability by contacting Colex Uniformes, S.L. at Polígono Industrial Can Tapioles, Calle Narcís Monturiol, 2 Nave 8-9, 08110 Montcada i Reixac (Barcelona), Spain, or online@colexuniformes.com. Additionally, you have the right to file complaints with the Data Protection Authorities.
8.2 Fields marked with * in the registration form are mandatory. Failure to answer these questions will prevent the purchase of selected products.
9. PASSWORDS
9.1 Colex will provide Users who register on the website with personal passwords for accessing services. The User is responsible for maintaining these passwords in strict confidentiality and will bear all consequences from any breach or disclosure of this confidentiality. For security reasons, Users can change their password at any time. The User must notify Colex immediately of any unauthorized use of their password or third-party access to it.
10. COOKIES
10.1 Colex uses cookies to improve its services, facilitate navigation, maintain security, verify the User's identity, facilitate access to personal preferences, and track usage of the Store. Cookies are files installed on the User's computer hard drive or browser memory to identify them.
10.2 If the User does not wish to have cookies installed on their hard drive, they should configure their browser not to receive them. The User can also delete cookies at any time. However, if the User disables cookies, service quality and speed may decrease, and access to some services in the Store may be lost.
11. APPLICABLE LAW AND JURISDICTION
These general terms and conditions are governed by Spanish legislation.
